Subject:  OTR Injustice Corrected

I want to bring to your attention a minor issue I consider an injustice
towards researchers of old time radio. For the past few years, a number of
web-sites have been posting radio logs (titles, broadcast dates, episode
numbers, etc.) on their web-site and, sadly, have not been giving credit
where credit is due. One such example is the following web-site:
[removed] which features a broadcast log
for MR. KEEN, TRACER OF LOST PERSONS. A number of years ago, Jim Cox, with
the hearty assistance of Stewart Wright, compiled an episode guide and book
about MR. KEEN for McFarland Publishing. Until that book was published, no
one had a broadcast log or episode guide on the subject. The log that appears
on that web-site clearly originates from Jim's book, with the same missing
gaps and obvious tell-tale signs. And the injustice I refer to is the fact
that Jim Cox receives absolutely no credit whatsoever. For the record, Jim
flew all the way to Wyoming and spent a lot of money out of his own pocket
copying the scripts (whole and in part) to compile that log. He's never
received enough money in royalties to reimburse his hard work, and worse, his
efforts is not being plagiarized, but they haven't had the decency to credit
or acknowledge him on the log.

This is just one of many examples that can be found on many web-sites. Many
of those individuals are subscribers of this digest and those very same
people defend their actions by claiming no one owns the copyrights to titles
and broadcast dates for radio shows. While this may be true, it's a defense
that steers away from the subject at hand. They defend their actions by
claiming they themselves are not posting their name as the author in the
byline, and therefore, claim they are not stealing credit. This is hogwash
because if I cut and paste a log onto my web-site, from someone else's site,
and then claim I'm not stealing credit because I didn't add "written by
Martin Grams" to the log, people will still assume I did it because it's on
my site. They defend themselves by claiming they are non-profit, but if it is
not money, the only reason I can see them doing this is to gain name and
recognition. Maybe that's an ego, I don't know. Whether they are profit or
non-profit is an "excuse," not a "reason" for doing what they do. They defend
themselves by claiming they tweak the logs with their own style or perhaps a
correction or two and therefore, since it's not the exact same log (even
though 95 plus percent is the same), they are not obligated to give credit to
the person who did the majority of the work. They defend themselves by
claiming they are providing a service for the public, but what service are
they providing when they are not being truthful in revealing who truly did
the research for what appears on their web-site?

This is NOT an issue about copyrights. This is NOT an issue about trademarks.
This is NOT an issue about book sales versus internet web-sites. This is a
moral and ethical issue about "stealing" logs without giving due credit. If
this isn't stealing or plagiarism, I'd like to know what they call it (with
fancy legal terminology, no doubt). It is a known fact that very few people
in this hobby are true researchers. That is, people who dig through the
archives at University libraries, track down family relatives and pay them a
visit to go through the family archives and collections, and visit the
Library of Congress to go through dramatic works. Very few people really do
this. Most people, sadly, simply refer to a bunch of previously published
reference books and while there is nothing wrong with that, there is a major
difference between consulting published books versus digging through the
archives. I, personally, would never consider anyone a researcher if all they
are doing is posting logs on their web-sites taken from books other people
truly researched. They may not be asking for my respect, but they have not
earned it.

I might be the only person who is presently voicing their disappointment
regarding this subject, because friends have told me they are afraid to do so
in fear of retaliation from those who have stolen from them. But I have had
private discussions (sometimes at backyard bar-b-ques) with authors,
researchers and even presidents of OTR clubs who have all expressed the same
[removed] and often against the same individuals. I do not intend to
police the web-sites that are "ripping off" other people's works, nor do I
have the time to do so. But I do feel it is my obligation to make public a
small list of web-sites and the logs that appear on those sites, and reveal
credit where credit is due.

Regarding the web-site listed [removed]

AS EASY AS ABC -- was originally compiled by Martin Grams from scripts at the
Library of Congress.
ARTHUR HOPKINS PRESENTS -- same
BROADWAY IS MY BEAT - copyright 7/5/96 by Terry Salomonson and no one has yet
provided a log pre-dating 7/5/96.
CABIN B-13 -- originally compiled by Martin Grams from scripts courtesy of
the John Dickson Carr estate
THE FIRST NIGHTER PROGRAM -- Ray Stanich deserves credit because he compiled
the log from the NBC files (many people will verify that and his log has been
in circulation for more than two decades).
GANG BUSTERS -- originated from my GANG BUSTERS book, thanks to Bill Abbott
who spent long hours at the Library of Congress.
MR. KEEN, TRACER OF LOST PERSONS -- as mentioned prior, Jim Cox deserves the
credit
HOPALONG CASSIDY -- Bernard Drew, who did the initial log (and copyrighted
it) in the early nineties and deserves the credit.
THE LONE RANGER -- We all know that Terry Salomonson receives credit for
compiling the only log ever done on THE LONE RANGER and from Trendle's
archive which is in Terry's possession. And Terry goofed by accident on one
title and it's on the web-site so if they did their own research, how did
they happen to have the same mistake that ONLY appeared in Terry's log (for
an episode that doesn't exist in recorded form so it didn't originate from a
collector catalog).
QUIET, PLEASE -- Randy Eidemiller and Chris Lembesis had access to the
original scripts, including the lost episodes, courtesy of the Library of
American Broadcasting in College Park. They did the only log that has since
been copied numerous times.
THE WITCH'S TALE -- David Siegel deserves credit for being the first and only
person to do a log on the show, who also owns the Alonzo Deen Cole archive.
21ST PRECINCT was originally done by Stewart Wright and originally appeared
in an issue of SPERDVAC. Where is his name credited?

FIRST NIGHTER PROGRAM -- again, Ray Stanich

This is just a SMALL sample of what can be found on the internet. Yes, I am
aware of shows like ESCAPE and X MINUS ONE where logs have been circulating
for decades and in those cases I have met a number of people, all of whom
have claimed they were the first to originate the logs and that everyone else
ripped them off. I am not centering or addressing those shows. Others like
BOX 13 and DAMON RUNYON THEATER are short runs and therefore anyone could
compile a log simply by collecting the recordings and using the titles and
dates provided in a vendor catalog. Again, I am not addressing those shows.

There is a web-site based out of Australia devoted to all things SUPERMAN.
They reprinted a broadcast log out of a book I edited, RADIO DRAMA, for their
web-site. They credited my name and RADIO DRAMA as the source. After sending
e-mails to the webmaster on an infrequent basis for a period of four years,
explaining that a man named Fred Shay did the log from the radio scripts in
his collection (which is clearly acknowledged in RADIO DRAMA), they have yet
to correct that. They still credit me when in fact, they should be crediting
Fred Shay. To this date, they continue to ignore my e-mails. (When I edited
RADIO DRAMA, I sought out those responsible for originating the log, sought
permission, and made sure it was evident throughout the book who did each of
those respective logs.)

Lou Genco once featured a broadcast log of DUFFY'S TAVERN on his web site.
Someone deliberately stole credit by posting their name as author. After a
friendly exchange with Lou, he provided me the e-mail address of the party
who submitted it to him. They did reply to my e-mail, claiming they got the
log from three issues of SPERDVAC (which I authored, by the way) and after
the explanation was delivered, Lou was kind enough to remove their name and
place mine in it's place. I wasn't trying to start any crap or take credit
for someone else's work. I was merely setting the record straight and Lou
(God bless him) was 100 percent honest and understanding about the situation
and made the effort to correct the error.

I feel sorry for Tom Price, who knew Jim Jordan personally, went through all
of the bound scripts in Jim's basement, and compiled the first broadcast
log/episode guide on the subject. To this day, people have been reprinting
the log (including titles for episodes not known to exist in recorded form --
the big tip-off) and fail to give him any credit. I once talked to Tom by
phone and asked if he was aware of this (during our conversation) and he
remarked, "that's why I don't care to get back into the hobby or research
another subject." He's out of the hobby altogether.

My co-author for the recent GREEN HORNET book was recently approached by
someone wanting to post a log based on the material from our book. They
didn't bother to ask both of us, they only approached Terry. The book hasn't
even been in print more than 60 days yet! Having paid The Green Hornet, Inc.
for the trademark use of The Black Beauty, Kato and The Green Hornet, for
which they receive a fee for every book sale, they do have a financial
interest in web-sites choosing to post information taken directly from the
book. Thanks to Terry and George Trendle Jr., about one third of the episodes
in circulation can now have the correct titles and airdates. And I know for a
fact that The Green Hornet, Inc. is keeping an eye out for those who choose
to impair sales by plagiarizing information from the book without due credit.
The internet has both helped and hurt the hobby. It's made it easier for
researchers to contact librarians across the country without the use of a
phone, receive scans of pages and photos without the unnecessary postal
expense, and tells people about books fans never knew existed. But on the
other hand, it has harmed book sales by giving people an excuse why they
shouldn't invest in a well-researched tome. But giving credit where credit is
due can help intrigue those seeking more info and thus counteract the effects
their actions cause by plagiarism.

In closing, we are all aware that everyone has the same goal in mind. To
create broadcast logs for radio programs to help document and preserve the
hobby. Without logs, we wouldn't have the correct dates and titles for
recordings in our collections. But recent efforts such as my GANG BUSTERS and
Jim Cox's MR. KEEN logs should, at the very least, be credited accordingly.
In other words, if you're going to rip off someone's hard earned efforts, at
least have the decency to acknowledge who's work you ripped off. There is no
excuse for anyone who posts a log on their site without giving due credit or
citing the source.

I know this posting will probably generate a negative e-mail or two towards
me (there is always someone who wants to debate or argue privately), and
dozens and dozens of "thank yous" via e-mail, but having discussed this with
a few authorities in the hobby, I felt it should be brought to light and set
the record straight. People, PLEASE give credit where credit is due.
