Subject:  Radio SPirits

Sadly, Radio Spirits knew this was going to happen before July 11.  Before 
that date I had already contacted one of the staff members of the 
accounting office to verify whether the $1,400+ worth of books I sent them 
would be paid for.  Though their answer was not direct over the phone, the 
man pretty much stated NO.  Which means all the books I sent them that 
today, they are still selling on their web-site and catalogs, I'm not going 
to get paid a penny.  Another reason why OTR authors don't make money and 
in this case, LOSE money on writing books.  It can be a write off, but 
financially it doesn't help.  (And yes, I did ask the man over the phone if 
he could mail what's left in stock and work something out and apparently 
they don't want to assist.  Makes me wish people like Karen Lerner ran the 
company because things like that wouldn't happen if she was in [removed])

Hello All:
     I am a member of the Jack Benny Fan Club Forums-There is a member with 
the username of Yhtapmys-I had no idea whre the reference was from until 
reading about the running gag on the Benny program  Now it makes sense.

     I have been listening to "Bob And Ray's Lost Episodes" on XM 163-Sonic 
Theater.  These had been over WCBS-880 in the mid-1950'[removed] referenced 
their Sunday evening drama shows such as Suspense, Gunsmoke, Yours Truly 
Johnny Dollar, [removed] promo spots.  I have always  enjoyed Bob and 
[removed] get tired of their characters and wordplay though I know to 
some, they are an acquired taste.

I periodically check out Hamilton Books and recently was surprised to find a
good number of Radio Spirits remaindered merchandise there, both tapes and
CDs.  I wonder if that's connected to Media Bays' shutting down all of its
businesses.

I do. Primarily for the quality of the recordings I get. I don't have the 
skills, nor the desire to learn them, for cleaning up recordings and 
improving their sounds. Others have greater access to better sources than I 
have. The ones I have been buying are of pristine quality in their sound. 
They are not compressed which limits the quantity I can purchase (because 
of space limitations. I've been purchasing from Radio Archives. I do wish 
they had a broader selection of programs I like, but what they have is 
great. I, too, am buried in mp3's. The Old Time Radio Researchers Group has 
great collections of mp3's. I MUST start scheduling time to better organize 
my collection.

I quit buying perhaps a decade ago. My needs were sufficient and I was 
satisfied with what I had. The generosity (which I cannot emphasize enough) 
of readers of this digest when I have lacked something for research has 
overwelmed me. So many have stood ready to supply recordings as gifts or on 
loan that I simply quit buying, except in rare cases that something 
surfaced that I wanted for pure enjoyment.

Dave Adams adds:

We should coin a term for that malady. I know of others who have it, 
including at least one in our own local club. Back in the nineties, when 
our club was founded by the late Tom McConnell, a prince of a fellow and an 
OTR czar, I went to his home on several occasions and was astounded by the 
tens of thousands of tapes and discs and recordings of every persuasion 
that bulged from his office and closets and wherever there was space. He 
had duplicating equipment in such volume his investment would have put a 
small radio station to shame. And he was continuing to collect like crazy, 
then in his mid to late sixties.

I inquired, Tom, have you heard all of these shows?" He shot back: "Nope! 
Don't ever expect to. I won't live long enough." Naturally, I responded, 
"Then why do you keep collecting?" He laughed: "So I'll have it." I've 
thought of that line every time somebody since has confessed to me that 
he's a habitual collector.

I think it's probably an as yet unclassified strain.

Radio Spirits/Media Bay only has some of his recordings, while Dave has many still in his possession. Like Metacom/Adventures in Cassettes, when he sold his business to Media Bay, he signed a contract stating he would not sell old time radio for a large number of years (if you're going to buy out your competition, you want to make sure they don't start up as competition again). So . . . even if he has a recording you want, he cannot do so legally. He's also retired and enjoying retired life. Most of Dave's collection was available for many years at the $[removed] per hour price and much of what he had did get into circulation so if you check around you can probably find what he has listed on his catalog. As for collecting OTR shows, Francis M. Nevins teaches copyright at the School of Law at St. Louis University. He's not a copyright attorney, he TEACHES copyright attornies. I don't intend to open up another can of worms about copyright but according to Mike, (and he does know what he is talking about since he's backed people who won court cases against film studios), making a copy of anything for yourself is NOT illegal. If you download it for yourself, it's not illegal. If you buy something and make a copy of it for yourself and turn around and sell the original, that is not illegal. But you cannot dispense the copy in any form (loan, trade, sell, rent, etc.) unless it's an original else it's illegal. As for whether radio shows are copyrighted or in the public domain, as Mike pointed out at a panel discussion at a convention recently, there is almost no such thing as public domain. Many vendors and people use that legal term as an excuse to sell stuff, or trade and own, but it's not just the initial copyrights. The characters can be trademarked, slogans can be trademarked, music scores can be copyrighted, etc. Even if the initial copyright expired for the script, that does not mean the show is in it's entirety in the public domain. And it gets tricky because large commercial companies have slipped and missed paying someone a license fee for something as simple as paying 25 cents to a supporting actors who had one line in a radio episode and wants their residuals. So be careful about quoting any OTR shows as being in the public domain. Very little is. And very little owners are enforcing their authority because in many cases it's not worth their time or trouble to do so. Not just because of what it does for the radio community: getting old shows in New ears. But personally, they were one of our best buyers of books. I haven't heard from them since hearing the news of their demise. I'm hoping someone Will take over for them. According to Paul Rapp (who is paid for his Bickersons material twice a year from them), there's another company trying to get the same sort of catalog into the mainstream. I can't recall its name offhand, but they're wanting to get into the Walmart/Sam's market, and I hope they do. Personally, I think the only way OTR is going to flourish in future, after even "young" guys like myself are gone, is to tie the past into the present. Do NEW radio shows, like they still do in the UK. Then do the opposite as well: get the Old ears interested in Young radio. Turn Just a Minute into a public radio show and get The Jerky Boys and Stan Freberg to do the pilot. I think progressive thinking is the best way of keeping the genre alive for all of us. Also, someone raised an interesting question here about "who buys OTR now?" Well, the above Rapp statement is a good example about how copyrights are thought of. Paul Rapp can prove he has the copyright on all the Bickerson stuff, so he's paid for it by Radio Spirits. Yet there are still some sites and ebay which sell a ton of Bix on a cd for 99 cents. That's hard to compete with. If someone figured out how to do that with my books, they might do that too. And I'd be out of a vocation, and then what would happen to a lot of New radio books? I don't mean that to sound as heroic as it does, but it's something to think about. I say - when you can, buy direct. Even if it's a little more. Buy Bickersons stuff from [removed] not ebay. Buy the Private Eyelashes book from [removed] not [removed] (which takes 55% of the cover price for being a middle man; because they order from me when they get orders). Support those companies who can mine More gold for fans in future. JUMP! I'm not a big nut about sound quality but when I see a bargain or a used collection at used book store I tend to buy commercially packaged shows. Over the I've come to trust the quality of the merchandise as far as sound reproduction and completeness of the episodes. I have been wrong on a few occasions but no very often. I'm not the volume collector I used to be and like Dave I have far more then I'll ever be able to listen to so picking up an ready prepared set is like getting a TV dinner when I don't want to cook. I'm hungry but I just don't want to take the time to do all of the work of preparing a meal. When I first started collecting OTR I was ordering OTR from online dealers two or three times a month but after I had collected 16,000 shows I realized there was no way I could listen to all those shows so in the last couple of years have slowed down in my collecting and only collecting shows that I am very interested in and completing sets of my favorites. OTR colllecting is a great hobby and allows us to be lost in a time when life was simpler and we appreciated being able to use our imaginations as the voices of the old time radio stars reverberated over the airwaves.
